Kristine M. Rodas, the widow of Roger W. Rodas, who was driving the Porsche sports car that crashed and killed him and actor Paul Walker is suing the automaker, NBC News reported. The accident occurred last November when Mr. Walker and Mr. Rodas were driving in a 2005 Porsche Carrera GT, which is capable of going faster than 200 miles per hour. One report claims the car was traveling as fast as 94 mph prior to the deadly crash, though Mrs. Rodas claims her husband was driving only at 55 miles per hour.
The lawsuit (Rodas v. Porsche Inc., Superior Court of California – Central District, Case No. BC545395) is alleging that the vehicle should have had a proper crash cage and certain safety features in the gas take that would have saved the lives of the two men had they been installed. The lawsuit further alleges that the car's suspension system was responsible for forcing the car to go out of control and crash. The lawyers are contending that the vehicle was "unsafe for its intended use" due to defects in its design, testing, and other features. The Los Angeles County Sherriff's Department and California Highway Patrol previously concluded that the cause of the accident was driving at an unsafe speed, not mechanical problems, though their investigation was aided by engineers from Porsche. The conflicting reports will be weighed during the ensuing litigation.
