336th District Court Felony Dispositions for January, 2014

Fannin County Criminal District Attorney Richard Glaser released a list of people who entered into plea agreements with his office during the January dockets before Judge Laurine Blake of the 336th District Court of Fannin County.  The following individuals either entered guilty pleas and accepted responsibility for their conduct without further court action or their cases went to trial and a Fannin County jury rendered the verdict and sentence indicated.

Justin Wayne Billy, 22 of Bonham ¨C pleaded guilty to the State Jail Felony offense of Theft Propertyover $1,500 and less than $20,000.  Billy was convicted and sentenced to serve a term of 300 days incarceration in the Texas Department of Criminal Justice ¨C State Jail Division, assessed $369 court costs, and $3,000 restitution.

Rex Allen Branough, 42 of Bonham ¨C pleaded guilty to the State Jail Felony offense of Burglary of a Building.  Branough was convicted and sentenced to serve a term of 18 months incarceration in the Texas Department of Criminal Justice ¨C State Jail Division and assessed $254 court costs.

Michelle Nicole Brookins, 31, of Bonham ¨C pleaded guilty to the State Jail Felony offenseof Attempt to Take Weapon From An Officer.  Brookins was convicted and sentenced to serve a term of 2 years incarceration in the Texas Department of Criminal Justice ¨C State Jail Division, assessed $254 court costs, and a $1,000 fine.  After sentencing Brookins, the court suspended her sentence and placed her on community supervision for a period of 5 years.

Dennis Wayne Brown, 46, of Savoy¨C pleaded true to the allegations contained in the State¡¯s Motion to Adjudicate Guilt and was convicted and sentenced to serve a term of 15 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed $249 court costs, and a $2,000 fine for the First Degree Felony offense of Aggravated Assault Date/Family/House with Weapon committed on September 9, 2011.

Charles Glenn Cagle, 59, of Bonham ¨C pleaded guilty to the State Jail Felony offense of Theft of Property<$1,500 with Two (2) or More Previous Convictions¡ªEnhanced.  Cagle was convicted and sentenced to serve a term of 3 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed $254 court costs, and $24 restitution.

Carlos Evaristo Cardenas, 33, of Garland¨C pleaded true to the allegations contained in the State¡¯s Motion to Adjudicate Guilt and was convicted and sentenced to serve a term of 5 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed $205.25 court costs, and a $28 fine for the First Degree Felony offense of Manufacture or Delivery of a CS (controlled substance) PG 1 (Penalty Group 1) ¡Ý4G<200G (greater or equal to 4 grams but less than 200 grams)committed on September 15, 2003.

Miguel Jesus Castillo, 17, of Bonham ¨C pleaded guilty to the State Jail Felony offense of Burglary of a Building.  Castillo was placed on Deferred Adjudication Community Supervision for a period of 5 years, assessed a $1,000 fine, $305 restitution and $249 court costs.

Melody Marie Cooley, 46, of Leonard ¨C pleaded guilty to the State Jail Felony offense of Man Del CS PG 1 <1G (Manufacture Delivery of a Controlled Substance in Penalty Group 1 Under 1 Gram).  Cooley was placed on Deferred Adjudication Community Supervision for a period of 5 years, assessed a $2,000 fine, and $329 court costs.

Keith Ray Crabtree, 37, of Dodd City ¨C pleaded guilty to the Third Degree Felony offense of Sex Offenders Duty to Register Life/Annually¡ªEnhanced.  Crabtree was convicted and sentenced to serve a term of 6 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $304 court costs.

Juan Cruz, Jr., 31, of Bonham ¨C pleaded guilty to the Third Degree Felony offense of Assault Family/House Member Impede Breath/Circulation.  Cruz was convicted and sentenced to serve a term of 3 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $254 court costs.

Juan Cruz, Jr., 31, of Bonham ¨C pleaded guilty to the Second Degree Felony offense of Aggravated Assault w/Deadly Weapon.  Cruz was convicted and sentenced to serve a term of 3 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $254 court costs.

Samantha Davis, 29, of Anna ¨C pleaded guilty to the Second Degree Felony offense of Man Del CS PG 1 ¡Ý1G<4G.  Davis was convicted and sentenced to serve a term of 3 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $309 court costs.

Johnny Barrera Delatorre, 59, of Bonham ¨C pleaded guilty to the Third Degree Felony offense of Driving While Intoxicated 3rd or More¡ªEnhanced.  Delatorre was convicted and sentenced to serve a term of 5 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed $394 court costs, and $80 restitution.

Clinton Dale Espy, 37, of Paris ¨C pleaded guilty to the Third Degree Felony offense of Evading Arrest Detention w/Vehicle¡ªEnhanced.  Espy was convicted and sentenced to serve a term of 20 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $314 court costs.Espy¡¯s sentences will run concurrently.

Clinton Dale Espy, 37, of Paris ¨C pleaded guilty to the Second Degree Felony offense of Aggravated Assault w/Deadly Weapon¡ªEnhanced.  Espy was convicted and sentenced to serve a term of 20 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $364 court costs.Espy¡¯s sentences will run concurrently.

Clinton Dale Espy, 37, of Paris ¨C pleaded guilty to the Second Degree Felony offense of Man Del CS PG 1 ¡Ý1G<4G ¨C Enhanced.  Espy was convicted and sentenced to serve a term of 20 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed $314 court costs, and $140 restitution.Espy¡¯s sentences will run concurrently.

Adam Gaytan, 29, of Bonham ¨C pleaded guilty to the Third Degree Felony offense of Injury Child/Elderly/Disable w/Intent Bodily Injury¡ªEnhanced.  Gaytan was convicted and sentenced to serve a term of 2 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $319 court costs.

Ryan Paul Hamilton, 32, of Blue Ridge¨C pleaded true to the allegations contained in the State¡¯s Motion to Adjudicate Guilt and was convicted and sentenced to serve a term of 6 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $239 court costs for the Third Degree Felony offense of Sex Offenders Duty to Register Life/Annually committed on May 24, 2013.

Crystal Gayle Hewett, 32, of Ector ¨C pleaded guilty to seven allegations of the Third Degree Felony offense of Fraud Possession CS/Prescription SCH III/IV.  Hewett was placed on Deferred Adjudication Community Supervision for a period of 10 years, assessed a $2,000 fine, and $2,303 court costs.

Eli Glenn Hunter, 22, of Whitewright ¨C pleaded true to the allegations contained in the State¡¯s Motion to Revoke Probation and was convicted and sentenced to serve a term of 10 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, assessed a $1,200 fine, $404 court costs, and $15,273 restitution for the Third Degree Felony offense of Intoxicated Assault w/Vehicle SBI committed on March 27, 2010.Hunter¡¯s sentences will run concurrently.

Corey Don Louis, 44, of Bonham ¨C pleaded guilty to two allegations of the First Degree Felony offense of Injury Child/Elderly/Disable w/SBI Mental¡ªEnhanced.  Louis was convicted and sentenced to serve a term of 15 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division, and assessed $507.77 court costs.  Louis¡¯s sentences will run concurrently.

Casey Wayne Moore, 32 of Savoy ¨C pleaded guilty to the State Jail Felony offense of Theft of a Firearm.  Moore was convicted and sentenced to serve a term of 2 years incarceration in the Texas Department of Criminal Justice ¨C State Jail Division, assessed $269 court costs, a $1,500 fine, and $50 restitution.  After sentencing Moore, the court suspended his sentence and placed him on community supervision for a period of 4 years.

Timothy Shayne Osborne, 37, of Bonham ¨C pleaded guilty to the Class A Misdemeanor offense of Assault Causes Bodily Injury Family Member.  Osborne was placed on Deferred Adjudication Community Supervision for a period of 2 years, assessed a $500 fine, and $269 court costs.

Rodney Del Shaw, 36, of Mesquite¨Cpleaded guilty to the Third Degree Felony offense of Tamper/Fabricate Physical Evidence.  Shaw was convicted and sentenced to serve a term of 4 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $254 court costs.Shaw¡¯s sentences will run concurrently.

Rodney Del Shaw, 36, of Mesquite ¨C pleaded guilty to the State Jail Felony offense of Possession CS PG 1 <1G.  Shaw was convicted and sentenced to a term of 12 months incarceration in the Texas Department of Criminal Justice ¨C State Jail Divisionand assessed $314 court costs. Shaw¡¯s sentences will run concurrently.

Rodney Del Shaw, 36, of Mesquite ¨Cpleaded guilty to the State Jail Felony offense of Man Del CS PG 1 <1G.  Shaw was convicted and sentenced to serve a term of 12 months incarceration in the Texas Department of Criminal Justice ¨C State Jail Divisionand assessed $314 court costs.  Shaw¡¯s sentences will run concurrently.

Charles Ray Stauts, 48, of Telephone ¨C pleaded guilty to the Third Degree Felony offense of Theft of Prop ¡Ý$20K <$100K¡ªEnhanced.  Stauts was convicted and sentenced to serve a term of 10 years incarceration in the Texas Department of Criminal Justice ¨C Institutional Division and assessed $254 court costs.

A.W. Turner, Jr., 55 of Greenville ¨Cpleaded true to the allegations contained in the State¡¯s Motion to Revoke Probation and was convicted and sentenced to serve a term of 2 years incarceration in the Texas Department of Criminal Justice ¨C State Jail Division, assessed a $728 fine, $142.25 court costs, and $212 restitution for the State Jail Felony offense of Man Del CS PG 1 <1G committed on September 30, 1999.

Ronald Ray Whisenhunt, 48, of Bonham ¨C pleaded guilty to the Class A Misdemeanor offense of Driving While Intoxicated 2nd.  Whisenhunt was convicted and sentenced to serve a term of 1 year incarceration in the Fannin County Jail, assessed $329 court costs, a $500 fine, and $160 restitution.  After sentencing Whisenhunt, the court suspended his sentence and placed him on community supervision for a period of 2 years.

Tyran Deleon White, 33, of Bonham ¨C pleaded guilty to the State Jail Felony offense of Possession CS PG 1 <1G.  White was convicted and sentenced to serve a term of 9 months incarceration in the Texas Department of Criminal Justice ¨C State Jail Divisionand assessed $314 court costs.

Marlon Jordan Wilson, 57, of Bonham ¨C pleaded guilty to the Third Degree Felony offense of Man Del CS PG 3/4 <28G Drug Free Zone.  Wilson was placed on Deferred Adjudication Community Supervision for a period of 3 years, assessed a $500 fine, $329 court costs, and $140 restitution.
